Abstract

In anthropological and legal literature, the phenomenon termed ‘legal pluralism’ has been interpreted as a co-presence of legal orders which act in relation to their own ‘levels’ of referring ‘fields’. The Afghan normative network is generally described in terms of pluralism, where different normative systems coexist: such as customs, shari’a (Islamic law), state laws and principles deriving from international standard of rights (e.g., human rights). In this article I abandon the neutral category of legal pluralism in order to bring forward a hypothesis of an inaccessible normative pluralism as a key concept in order to capture the structural injustices, of which Afghans are victims. Globally, the debates concerning the diffusion and application of human rights develop at the same time ideologically, politically and  pragmatically. Today in Afghanistan these levels are expressed in all their complexity and ambivalence; it is therefore particularly significant to closely observe the work done by the Afghanistan Independent Human Rights Commission. Starting with my research fieldwork in Afghanistan (2005-2012) – where I studied judicial practices in the courts of Kabul, developing a reflection which weaves the spread of human rights with the themes of injustice and inaccessibility – I argue in this article the urgency and the necessity to concentrate on the contingent dimension of (in)justice.

Abstract

This paper seeks to develop a framework for analyzing the political sociology of emigration. The paper emphasizes the dualities at the heart of the migration phenomenon: immigrants are also emigrants, aliens are also citizens, foreigners are also nationals, non-members are also members. At once of the sending state, but not in it, the migrants are members whose everyday cross-border connections and ongoing needs draw the sending state across the borders; residing abroad, however, their claims to belonging are undermined by their presence on foreign soil. At once in the receiving state but not of it, the migrants can access the economic and political resources available in their new home, using them to gain leverage in the home left behind; yet as outsiders, their rights are circumscribed and their acceptance is uncertain, vulnerabilities that can be aggravated if continuing homeland involvement triggers the suspicion of receiving state nationals. Both conditions activate interventions by home states seeking to influence and protect nationals abroad. While extension to the territory of another state keeps options inherently limited, even limited engagements can inflame the passions of receiving state nationals, already anxious about the foreigners in their midst.

Abstract

We defend a methodology of discounting, for the evaluation of the long-term effects of climate policies, which relies on a social welfare objective, against the view that the market rate of return should be used for that purpose. We also show that in the long run, the discount rate for such policies should focus on the worst-case scenario for the most disadvantaged populations. As a consequence, it is likely that the appropriate discount rate for climate policies should be negative, implying a high priority for the future.

Abstract

In his classic 1944 book, The Great Transformation, Karl Polanyi traced the roots of capitalist crisis to efforts to create “self-regulating markets” in land, labor, and money. The effect was to turn those three fundamental bases of social life into “fictitious commodities”.The inevitable result, Polanyi claimed, was to despoil nature, rupture communities, and destroy livelihoods. This diagnosis has strong echoes in the 21st century: witness the burgeoning markets in carbon emissions and biotechnology; in child-care, schooling, and the care of the old; and in financial derivatives. In this situation, Polanyi’s idea of fictitious commodification affords a promising basis for an integrated structural analysis that connects three dimensions of the present crisis, the ecological, the social, and the financial. This paper explores the strengths and weaknesses of Polanyi’s idea.

The text

This essay is the introduction to the forthcoming book under the direction of Nancy Fraser, entitled Le féminisme en mouvements : De l’insurrection des années 60 au néolibéralisme, to be published in French in October 2012 by La Découverte (Paris).

Abstract

An introduction to my forthcoming book, this essay takes a broad, sweeping look at second-wave feminism, situating the movement’s unfolding in relation to three moments in the history of capitalism. In the first moment, feminism posed a radical challenge to the pervasive androcentrism of “state-organized capitalism”. In the second, the movement unwittingly supplied a key ingredient of what Luc Boltanski and Eve Chiapello call the “new spirit” of neoliberal capitalism. In the third (present) moment, of capitalist crisis, feminists have the chance to reactivate the movement’s emancipatory promise.

Abstract

The paper explores in depth the intertwining of the social and the cognitive aspects of language in Ferdinand de Saussure’s classic Course in General Linguistics. This text has been put to new use recently by philosopher Patrice Maniglier, La Vie énigmatique des signes. The central problem for Maniglier is the resuscitation of the Saussure’s central notion of the ‘sign’ in the context of AI [artificial intelligence] / Cognitive Science. The main question is whether a naturally and mechanically arising linguistic ‘sign’ can remain indefinitely open-ended in the sense of the poststructuralists, and whether new cognitive ‘cultural milieus’ are continuously created on the basis of human contacts. Saussure seems to have much to say on this.

Abstract

The contemporary anti-racist zeal is banning the word ‘race’ of our everyday vocabulary. This practice was sanctioned by UNESCO in the postwar years and is now widespread in the press in Brazil. ‘Skin colour’ became the morally correct way to refer to physical differences before covered by the idea of ‘race’. Such a development would be inconsequential if the contemporary social sciences had not included in our vocabulary ‘skin colour’ as a natural concept, morally neutral. In this article, taking a Brazilian perspective, where ‘colour’ was historically constructed as a variant of ‘race’, I try to show the deception of such a naturalistic practice, and suggest that the classification of people by ‘skin colour’, not only has its foundation in the idea of race, but tends to bipolarity, unlike the Brazilian concept of ‘colour’, which is based on the ideology of whitening.

Monetary of Structural Inflation ? A bi-sectoral heterodox model.

Abstract

The issue of inflation targeting had concentrated a lot of discussion in the last twenty years. Not surprisingly the old dogma of a pure « monetary » inflation has been challenged and so was too the idea that the lowest the inflation the better. The very notion of « output gap » is showing that the level of inflation matters for growth and sometimes inflation and growth are positively correlated. This is to be linked with the idea of « strategic dependencies » between sectors but also to context-dependant behaviours. This is an important result, and one which could have an important relevance for the analysis of the current Eurozone crisis and the policy of the ECB.

After discussing assumptions about structural and nominal rigidities and comparing some results, we draw in this document a bi-sectoral model, borrowing some important ideas to Mankyw and Reis but developing them into a more heterodox and post-Keynesian framework.

Why such Rapid Growth among Southeast Asian Agricultures?

Abstract

Since the early 1960s, agricultural growth has been strong among most Southeast Asian countries. Largely fed by a dynamic relationship between agricultural intensification and territorial expansion, this strong growth concerns nearly all forms of production whether food or non-food, whether rice or cash crops such as palm oil, rubber or coffee. But the major factors behind these successes have been state policies. These have facilitated the adoption of new technologies among agricultural communities, particularly those associated with the Green Revolution as well as massive land opening towards the respective national territorial margins. More recently, this expansion has reached into the maritime domain, with the development of fish production including through marine aquaculture. This has led, first, to an acceleration of environmental deterioration which concerns in particular both the forest domain, including mangroves, and the maritime domain itself. Secondly, although until recently agricultural food production had held its ground so to speak, growing at equivalent speed with cash crop production, it is now beginning to fall behind. The growing submission of the region’s agricultures to world market demand goes hand in hand with the increasing role played by agro-food multinationals which everywhere are replacing the states in monitoring the national agricultural domains, pioneer fronts included.

Euro : the time of reassessing it has come (Fifteen lessons and six conclusions)

Abstract

The Eurozone is clearly in a time of crisis. However the liquidity crisis it is facing now, for all its urgency, is just the result of a deeper and longer internal competitiveness one. This crisis has been the result of making a monetary union before and without building a federal state. But building a federal state is at best a long and probably painful undertaking, whose success is not guaranteed. As a result the deepening of the crisis has been tremendous in the last months.

One solution now seen is the so-called « federalist jump » but this describe actually only making federal rules on expenditures and not sharing the revenue side. It is not to work both for political and economic reason. We survey also the potential issue of an asymmetric German inflation and found it a non-starter. This is letting the Eurozone only with wage-deflation policies, which are reminiscent of deflationary policies implemented in the early 30’s with disastrous effect. In this situation the only sensible solution looks to be a coordinated dismantling of the Eurozone.

Abstract

This paper proposes four concepts of exploitation that encapsulate common uses of the word in social interactions: unfair advantage, unequal exchange, using persons as means, free-riding. It briefly discusses how these concepts appear in the literature (the first two are prominent in Roemer’s classical work), and then examines how these forms of exploitation are related and how they can occur.

Abstract

In The Myth of Ownership – Taxes and Justice, Liam Murphy and Thomas Nagel (2002) launch an attack against a straw man, the economist who believes that taxation should minimally interfere with property rights and should seek to preserve the market distribution of wealth and income. Instead they propose an approach that focuses on the consequences of any form of public intervention for the distribution of welfare, without any particular ethical concern for the values emerging from the market. In fact, such an approach has been long developed by Mirrlees (1971), whose approach has been dominating the economics of taxation for the last forty years. But more recently the fairness approach to taxation goes beyond welfare consequentialism and attributes some value to market allocations, in line with the theories of justice proposed by Rawls and Dworkin.

Abstract

Transnational organized crime is a pressing global security issue. Mexico is currently embroiled in a protracted drug war. Mexican drug cartels and allied gangs (actually poly-crime organizations) are currently challenging states and sub-state polities (in Mexico, Guatemala, El Salvador and beyond) to capitalize on lucrative illicit global economic markets. As a consequence of the exploitation of these global economic flows, the cartels are waging war on each other and state institutions to gain control of the illicit economy. Essentially, they are waging a ‘criminal insurgency’ against the current configuration of states. As such, they are becoming political, as well as economic actors.

This presentation examines the dynamics of this controversial proposition. The control of territorial space — ranging from ‘failed communities’ to ‘failed regions’ — will be examined. The presentation will examine the exploitation of weak governance and areas (known as ‘lawless zones,’ ‘ungoverned spaces,’ ‘other governed spaces,’ or ‘zones of impunity’) where state challengers have created parallel or dual sovereignty, or ‘criminal enclaves’ in a neo-feudal political arrangement. The use of instrumental violence, corruption, information operations (including attacks on journalists), street taxation, and provision of social goods in a utilitarian fashion will be discussed. Finally, the dynamics of the transition of cartels and gangs into ‘accidental guerrillas’ and ‘social bandits’ will be explored through the lens of ‘third generation gang’ theory and ‘power-counter power’ relationships. This presentation will serve as a starting point for assessing the threat to security from transnational organized crime through lessons from the Mexican cartels.
